Terms of Service

1. Agreement to Terms
By accessing or using any services provided by Crave Digital, Inc. ("Company," "we," "us"), you agree to be bound by these Terms of Service. If you do not agree, do not use our services.
2. Services
Crave Digital provides AI workflow automation, website design, and related consulting services for businesses. Specific deliverables, timelines, and pricing are defined in the individual service agreement or proposal signed by both parties.
3. Client Obligations
- Provide timely access to accounts, credentials, and content needed for project completion.
- Respond to requests for feedback or approval within 48 business hours unless otherwise agreed.
- Ensure all content provided to Crave Digital is lawfully owned or licensed by you.
4. Payment Terms
- Setup fees are due before work begins, per the signed service agreement.
- Monthly retainers are billed on the 1st of each month and due within 7 days.
- Late payments incur a 1.5% monthly fee on the outstanding balance.
- Crave Digital reserves the right to pause services after 14 days of non-payment.
5. Minimum Commitment
AI Automation System retainer agreements require a 3-month minimum commitment. Early termination within this period forfeits the remaining balance of the commitment period.
6. Intellectual Property
- Client content: You retain ownership of all content, brand assets, and data you provide.
- Deliverables: Upon full payment, you own the custom automations, websites, and reports built for your business.
- Our tools: Crave Digital retains ownership of proprietary templates, frameworks, and processes used to deliver services.
7. Confidentiality
Both parties agree to keep confidential any proprietary information shared during the engagement. This obligation survives termination of the agreement for a period of two (2) years.
8. Guarantee
Our AI Automation System includes a performance guarantee as described in the signed service agreement. If the agreed-upon metrics are not met within 30 days of full deployment, the client is not obligated to pay for Month 2 of the retainer. The guarantee applies only when the client has fulfilled all obligations outlined in Section 3.
9. Limitation of Liability
Crave Digital's total liability under any service agreement shall not exceed the total fees paid by the client in the 3 months preceding the claim. We are not liable for indirect, incidental, or consequential damages, including lost revenue or data.
10. Termination
- Either party may terminate a month-to-month retainer with 30 days' written notice.
- Crave Digital may terminate immediately for non-payment or breach of these terms.
- Upon termination, all client data and deliverables will be transferred to the client within 14 business days.
11. Dispute Resolution
Any disputes arising from these terms or related services will be resolved through binding arbitration in the state of the Company's principal place of business, in accordance with the rules of the American Arbitration Association.
12. Changes to Terms
We may update these terms at any time. Clients with active agreements will be notified of material changes at least 30 days in advance. Continued use of services after notice constitutes acceptance.
